Real Estate 101: 3 Things That you Don't Know About Bankruptcy 

Are you considering filing for Bankruptcy? 3 things Home Owners need to know:

1. Ownership- When you file for bankruptcy, the dept maybe discharged at closing, but you still own the property. That means you still own the liabilities and the house. That includes property taxes, insurance, HOA dues, liabilities and any liens on the home not specified.
2. Liens- Any liens on the home need to be considered in the bankruptcy. You may or many not be responsible for the liens but the mortgage is still recorded; it is not free & clear. That means you are still responsible for the mortgage and possibly the liens too.
3. Moving out? If you filed for bankruptcy, keep in mind you still own the house. So even if you have moved out- you still have the liability, and the bank can foreclose and wreck your credit score.

Understand the correct way to vest your home. Vesting is how you take title to the deed. Death  happens- do your best to protect your interest in the property. If you are married you can easily make sure the property passes to you. There are also options to put your home in a Trust so it can avoid probate.

Cant Afford The Home On Your Own-

Classic hardship- if your spouse passes away,  you can often negotiate with the bank to get out from under the loan, especially when you can no longer afford the payments on your own.

Short Sale- 

If it is a short sale- when there is no equity- it's technically not in your favor to inherit the property. Avoid Mortgage Tax issues and know your rights. You can let it go to foreclosure, but instead we recommend you take action and get rid of it sooner than later.
